Credit Card Debt - Take Care

    Financial Services:

Not everyone realizes that personal loans and credit card debts could lead to the recovery of their homes, even if the mortgage repayments are up to date.

The Financial Services Authority, or FSA, expressed its concerns and issued a warning to lenders regarding their attitude towards borrowers who are in financial difficulty and are behind with their repayments. Construction companies and banks are also concerned about the number of non-mortgage loans that trigger the recovery. A northern construction society reports that more than a quarter of all its recoveries were actually caused by lenders that are not themselves.

Some more aggressive lenders are making use of a lesser known law that allows them to convert unsecured loans into a debt in a person's home. People who took out, for example, a loan to consolidate a number of debts are having difficulties.

It is possible that the lender may submit an application to the courts for what is called a "collection order" that effectively converts the debts into a secured loan, secured against your home.

These loans are more realistic than a mortgage and the money owed is recorded in the Land Registry as a "second charge" on your home. If your house is recovered, the lender of that loan will be the second in line for the payment, after your principal mortgage lender has recovered what is due.

There is concern that when property prices fall, there will not be enough money left in the amount obtained from the sale to pay the second lender. As they are nervous about this, these lenders are very quick to request a judgment in court if they fall behind with the payments. There is nothing your main mortgage lender can do about it.

The traditional advice when getting a guaranteed loan is that you should keep in mind that if you fall behind with the payments, you could lose your property. However, this warning was not issued with unsecured loans and, due to this lack of risk, they had a higher interest rate. If the lenders convert them into guaranteed loans, the situation changes completely.

For anyone who is in this position, the first thing to do is to seek good advice from someone with experience in the situation. One of those sources is the credit action Credit Action, whose spokesman says that "these arrears are a time bomb. There is no way to avoid the fact that recoveries will continue to increase."

You could possibly receive a notice of possession, a sales notice or a collection order. If you do, it is possible to appeal against it by carefully presenting a complete statement of your finances and clearly showing how you plan to handle the financial situation regarding the payment of the loan.

You should take this very seriously. The fact is that if you go to an appeal after you have done all your homework and show that you are not treating things in a frivolous way, but are trying to resolve things thoroughly, then you may not get lost. Even if a recovery order is issued, the courts suspend a large number of people, so that people have more time to put their finances in shape.
